Legal Agreement for zytePe

Welcome to zytePe. By accessing our platform, you agree to the following terms and conditions. We provide a robust financial infrastructure designed to empower internet businesses and individual users through secure payment processing, automated payouts, and comprehensive digital operation management.

Our "Services" refer to the digital ecosystem provided by zytePe, including our APIs, web interfaces, and business tools. "Business Users" are entities utilizing our infrastructure to serve their own "End Customers," while "End User Services" refer to direct-to-consumer financial tools provided for personal use.

Key Definitions

Access Credentials: Any private keys, developer IDs, or authentication passwords issued to the Customer for secure environment access.

The API: The Application Program Interface and its accompanying documentation provided to facilitate system integration.

Applicable Regulation: All statutory laws and guidelines governing financial transactions and data privacy within the jurisdiction of India.

Service & Subscription Framework

Subscription Management: Access to specific features is determined by the selected Subscription Plan. zytePe reserves the right to adjust pricing or feature sets at the start of any new billing cycle. Continued use of the service constitutes acceptance of these modifications.

Billing Authorization: By selecting a paid tier, the Customer authorizes zytePe to execute recurring charges to the registered payment method. This remains in effect until formal cancellation or the conclusion of the subscription term.

Usage Upgrades: To ensure uninterrupted service, accounts exceeding their plan limits may be automatically transitioned to the next tier. All such fees are non-refundable and cover the increased infrastructure overhead.

Financial Terms & Taxation

Tax Responsibility: All listed fees are exclusive of GST and other statutory levies. Customers are responsible for the settlement of all applicable taxes. Payments must be made in full without deductions; if withholding is legally required, the payment must be grossed up to ensure zytePe receives the net amount due.

Refund Policy: Unless mandated by local consumer protection laws, all service fees, including overages and upgrades, are strictly non-refundable. Upon cancellation, accounts will revert to a basic tier at the end of the current period.

Acceptable Use & Conduct

Eligibility: Users must be of legal age to form a binding contract. You agree not to use zytePe for any illicit activity, including but not limited to fraud, money laundering, or intellectual property infringement.

Security: The transmission of malicious code, viruses, or any attempt to circumvent our security protocols is strictly prohibited and will result in immediate account termination.

Restricted Business Categories

The following industries are strictly prohibited from using zytePe services:

  • Unregulated Gambling & Speculative Gaming
  • Chit Funds & Ponzi Schemes
  • Multi-Level Marketing (MLM)
  • Unlicensed Financial Advice
  • Adult Entertainment Services
  • Illegal Substance Trade
Liability & Indemnification

Limitation of Liability: zytePe and its affiliates shall not be liable for incidental or consequential damages arising from service use, including data loss or profit interruptions, to the maximum extent permitted by law.

Indemnity: Customers agree to indemnify and hold harmless zytePe from any third-party claims arising from the Customer's breach of these terms or misuse of the platform.

Governing Law

This agreement is governed by and construed in accordance with the Laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts where the company is registered.

Payment Processing & Chargebacks

zytePe acts as a facilitator and is not responsible for disputes regarding product quality or delivery between merchants and customers. Standard settlement cycles (T+2) apply, subject to nodal bank working days.

Chargebacks will be processed in coordination with banking partners. Merchants are required to provide proof of service/delivery within the stipulated timeframe to contest any chargeback requests.
